MEDFERRY SVC Terms & Conditions
These terms and conditions and the web-based booking form constitute the entire Agreement concerning the provision of a rider transfer service (“Service”) between you and your personal driver operating or under taking journeys for or on behalf of "MEDFERRY SVC". Completion of the booking form and use of the rider service indicates your unconditional acceptance of the terms and conditions set out in this Agreement.
This contract shall be governed by and construed in accordance with the laws of New York.
I agree to MEDFERRY SVC Terms & Conditions which include that MEDFERRY SVC is: the booking agent, and all personal rider transfers are provided by MEDFERRY SVC with fully insured & licensed Private Hire Operators/drivers and is not liable for the performance of the individual Private Hire Operator/driver, nor any indirect or consequential losses arising from your driver.
1. Definitions
“MEDFERRY SVC” means MEDFERRY SVC.

2 Booking:
2.1. You must allow enough time when booking your ride to allow for the check-in times required by your airline and for any delays caused by traffic conditions MEDFERRY SVC and or your personal driver shall not be responsible for any delay caused by your failure to allow enough time to reach your destination or if any passenger/s are not ready for collection at the booked time.
2.2. You must order a suitable car size for the number of passengers and luggage MEDFERRY SVC and or your personal driver cannot guarantee to carry excess amounts of luggage. Please note that a child, no matter what age, counts as one passenger as seat occupied.
3. Prices & Payment:
When requested, MEDFERRY SVC will email you a quotation based on the information supplied by you. MEDFERRY SVC may amend the quotation if there is any material change to the original itinerary, the number of passengers, or the type or size of vehicle required.
3.1. I agree and understand the booked/fixed price route for all BUF-NIA Buffalo-Niagara Airport & Buffalo City transfers is via the 33W Scajaquada Expressway or Genesee Street.
3.2. The quotation will include a [30] minute waiting period after the advertised landing time and the cost of car parking. MEDFERRY SVC and or your personal driver will NOT charge for flight delays on any private rider transfers but will charge for waiting at its standard rates
(currently $15.00 per hour) after the first 30 minute period has expired for any other type of delay (Immigration, Passport control, Baggage claims) MEDFERRY SVC and or your individual driver will endeavor to check for flight delays before leaving for the airport but shall be under no obligation to do so.
3.3. If you accept the quotation, you will receive confirmation of your booking by email. Please check your booking confirmation carefully and inform MEDFERRY SVC promptly of any errors MEDFERRY SVC and or your personal driver shall not be responsible for any delays caused or costs arising from by your failure to give MEDFERRY SVC correct information.
3.4. All journeys originating at an airport (which are not return journeys where MEDFERRY SVC has taken you to the airport) to be prepaid in full before the date of travel.
3.5. Payment accepted by credit card, debit card, cash or GooglePay or any of the other convenient ways listed on our web.
4. The Service:
4.1. You shall be responsible for the behavior of all the passengers in the vehicle during the journey. You will be charged $40.00 - $50.00 to cover the driver"s costs in the unlikely event of the vehicle being soiled by any passenger!
4.2. Eating, drinking and/or smoking in the cars are not permitted.
4.3. All children travelling during the journey should be restrained in a manner appropriate to their age, weight and height. Suitable child seats can be provided by prior request only.
MEDFERRY SVC are on occasions able to provide a form of child seat. If you require a child seat for your journey it must be requested 24 hours prior to travel.
4.4MEDFERRY SVC and or your personal driver will not carry more passengers than the individual insured/licenced vehicle allows.
5. Cancellations:
If you need to cancel your booking, you must contact us by email immediately.
MEDFERRY SVC will accept any cancellation made for a private rider booking as long as there is at least 48 hours’ notice. However, there will be a 10% administration / transaction charge. The cancellation must be made by email to which you will receive a cancellation confirmation.
MEDFERRY SVC will accept any cancellation made for a private rider booking as long as there is at least 24 hours’ notice. However, there will be a 50% administration / transaction charge. The cancellation must be made by email to which you will receive a cancellation confirmation.
MEDFERRY SVC will accept any cancellation made for a private rider booking as long as there is at least 5 hours’ notice. However, there will be a 75% administration / transaction charge. The cancellation must be made by email to which you will receive a cancellation confirmation.
MEDFERRY SVC will accept any cancellation made for a private rider booking with less than 5 hours’ notice However, there will be a 100% administration / transaction charge. The cancellation must be made by email to which you will receive a cancellation confirmation.
MEDFERRY SVC will apply a 100% administration / transaction charge on all bookings when no email cancellation has been requested and obtained.
MEDFERRY SVC at its sole discretion, reserve the right to refund or not charge any cancellation fee if we can successfully cancel the driver in time before he/she is dispatched to collect you. (Subject to: The driver has not missed out on other journeys/work, other passenger/s and/or other journeys are not affected).
MEDFERRY SVC will always do everything possible to make sure recovery of full payment for ‘No Show’, ‘Not travelling-Confirmed’ private & sharing rider booking passenger/s.
No responsibilities for costs will be refunded to any passengers who do not show, fail to travel, or fail to wait for their driver or take alternative transport.
If you do not receive an email from MEDFERRY SVC confirming your requested cancellation then we have not received it. In this case please call our 24 hours number which is 716.322.0226. Refunds will not be issued if the passenger does not have a cancelled email confirmation.
No refund is issued at any time for cancellation of any agreed/confirmed shared rider transfers unless a replacement passenger is found for your seat/s.
All other circumstances where a refund maybe possible should be addressed directly with MEDFERRY SVC customer services.
Please note that calls maybe recorded for future reference and training purposes.
6. Liability:
6.1 All MEDFERRY SVC individual drivers, will take reasonable endeavors to get you to your destination on time, but none shall not be liable for any vehicle breakdowns, accidents, loss due to delays caused by road or traffic conditions beyond its control on the journey. Under no circumstances shall MEDFERRY SVC or individual drivers be liable (in contract, tort or otherwise) for any loss of profits, business or for any indirect or consequential loss whatsoever.
6.2. All luggage and personal items are carried entirely at your risk. MEDFERRY SVC recommends you have personal adequate travel insurance in force.
6.3MEDFERRY SVC shall be entitled to cancel all services in the event of a declared national emergency, riot, war, fuel shortage, extreme weather or terrorist attack, or other circumstances beyond its control. If the individual car breaks down during your journey MEDFERRY SVC will endeavor to arrange where and when possible an alternative car to complete the journey as soon as practicable.
In case of missed departure: Under no circumstances shall MEDFERRY SVC or individual drivers be liable (in contract, tort or otherwise) for any missed flights, loss of profits, business or for any indirect or consequential loss whatsoever. MEDFERRY SVC recommends you have personal adequate travel insurance in force.
6.4. You shall indemnify MEDFERRY SVC against all losses, costs, damages and expenses arising from any act or omission of any passenger in your party.
6.5MEDFERRY SVC is not liable for the performance of any individual Operator/driver, nor any indirect or consequential losses arising from it.
6.6 Your booked route for all BUF-NIA Airport & Buffalo City or Niagara NY transfers is via the 33 Scajaquada Expressway or Genesee Street.
7. Termination:
7.1MEDFERRY SVC will refuse or terminate any booking with immediate effect if it places any driver or vehicle at risk of damage,violence or abuse by you or by any passenger in your party and we will ask all passengers to vacate the vehicle as soon as it is safe to do so. No refunds will be given if the journey is terminated part way through the hire.
8. Miscellaneous:
8.1MEDFERRY SVC may subcontract its obligations under this Agreement.
8.2MEDFERRY SVC may change these terms and conditions at any time by posting changes online. Please review these terms and conditions regularly to ensure that you are aware of any changes. All existing bookings will be at the rate quoted or applicable rate in effect at the time of booking.
8.3MEDFERRY SVC shall store, process and use all information about your personal details in accordance with all federal and state data security requirements.

8.4. This Agreement and any accompanying quotation represent the entire agreement between you and MEDFERRY SVC in relation to its subject matter. If there is any discrepancy between the terms of this Agreement and the quotation, the terms of this Agreement shall prevail.
8.5. Nothing in this Agreement is intended to confer any benefit on any third party, whether pursuant to the Contracts (e.g. Rights of Third Parties Act 1999) or otherwise, and no third party shall have the right to enforce any rights under this Agreement except where otherwise agreed in writing.
9. Disputes:

10. Conveying of children:
10.1. MEDFERRY SVC are on occasions able to provide a form of child seat. If you require a child seat for your journey it must be requested 24 hours prior to travel.
10.2. All drivers are approved/licensed by State of New York’s DMV and City of Buffalo NY, Office of Licensing, City Hall. MEDFERRY SVC holds Full Disclosure Certificates and are individually fully insured.
11. Rider sharing:
If you are not willing to travel with others who may pay the same, pay more or pay less than you per seat, cancel your request immediately & do not accept any seat/s in a shared rider transfer.
11.1. If sharing is available will confirm pick up points and exact pick up time prior to your journey departing.
11.2. Without the consent of your driver & other sharing rider transfer passengers, pre-arranged shared rider transfers cannot wait after the agreed/scheduled collection time.
11.3. To protect all concerned: If you accept and confirm a seat/s in a shared rider transfer, you cannot cancel as other/s will also be confirmed and relying on you to travel at an agreed price. If you do cancel or fail to travel, your accepted/confirmed seat price will still be required to be paid unless we successfully find a replacement passenger/s for your seat/s. MEDFERRY SVC will always do everything possible to recover outstanding payment/s of *No Show" & "Non travelling confirmed" passenger/s.
11.4. Will have the right to cancel or give a full refund for any pre-paid shared rider payments if the number of expected passengers fail to travel, resulting in a loss of income to the scheduled rider operator/driver.
11.5. Will have the right to offer an increased price to sharing passengers if necessary to ensure travel.
11.6. Your individual driver reserve the right to refuse to take extra luggage if concerned luggage does not fit definition of term or is in contravention of controls on animal transfers and rights of animals in general. If you have more luggage with you than we were expecting we may charge $10 per extra item, provided we can get this into the vehicle/luggage transporter. We reserve the right to refuse to take the extra luggage if we are unable to accommodate this in our vehicle/luggage transporter, this means you maybe refused to travel and no fare/seat price will be refunded and or your confirmed/agreed seat price will still be required to be paid.
11.7. Will tell you of the transfer departure time from the airport at the time of your booking. We will do what we can to minimize the wait at the airport after you land, but cannot be held responsible for flight delays. If a shared rider does require to depart without you, no refund will be given for your seat/s.
11.8MEDFERRY SVC use carefully selected and approved local reliable companies/drivers where necessary and if appropriate. .
11.9. No refund at any time for cancellation of any agreed/confirmed seat/s in shared rider transfers unless a replacement passenger is found.
Rider sharing information:
To increase the chances of a cheaper rider transfer & as an alternative to paying a full price riders
MEDFERRY SVC will aim, to find suitable passengers & will offer seat/s in a suitable rider to match each persons stated budget.
We accept the only fixed price shared transfer available at this time is $18.00 per seat. (Airport to City route & is subject to 5 or more passengers travelling in the same rider).
I agree and accept, each seat if available, will be booked according to my budget not by how many passengers are travelling in the rider transfer.
I agree and accept, departing & returning rider transfers are offered subject to availability and individual seat prices may vary.
I agree & accept, split share riders are offered subject to availability and individual seat prices may vary. (e.g. passenger/s travelling one way, driver collects the other passenger/s at destination).
I understand MEDFERRY SVC also search other carefully selected companies for available options.
I accept and agree I am willing to travel in any shared rider transfer with other/s who may pay the same, pay more or pay less than myself per seat.
I understand the higher my budget, the better chance of obtaining a successful cheaper rider transfer.
I understand arranging shared rider transfers incurs vast administration time and cost, it is not always just the actual price of the rider to the driver which requires to be met.
I agree and understand if I miss my shared rider transfer no refund will be available and the price for my seat/s will still be required to be paid.
I agree and understand the route for all Buffalo-Niagara International Airport & the cities of Buffalo NY and Niagara Falls NY transfers is always via the 33 Expressway or Genesee Street.
Matching Riders
Shared riders are offered if available and individual seat prices may vary.
Example:
How much are you willing to pay for 1 seat?
A. I am willing to pay $35.00 per seat.
1. Result - If one suitable seat is found which matches your $35.00 stated budget, you will successfully travel and avoid paying a full price rider.
2. Result - If no suitable seat is found which matches your $35.00 stated budget, you will receive an email to inform you, your transfer request is unsuccessful.
Each seat if available, will be booked according to your budget, not by how many passengers are in the rider transfer.

We do everything possible to make sure all shared rider transfers travel successfully and safely.
We provide comfortable minivans for all riders, we never use buses or sedans.
All rider transfers provide a Door to Door Service!
Our search services are completely free of charge.
If available, we will instantly reserve you a seat which meets your stated budget and contact you immediately.
If no suitable seat is found, you will receive an “unsuccessful” email.
12. While we will do everything we can to get you to the airport on time, there are circumstances out with our control for which we accept no responsibility for, these are as follows, but not limited to: -
All adverse weather conditions, including high winds
All traffic restrictions and closures.
Excessive traffic
Accidents
Vehicle breakdowns
War or Natural disaster
Personal items, belongings inclusive of lost and left luggage
All passengers are advised to have adequate travel insurance prior to booking.
MEDFERRY SVC does not accept responsibility for any personal belongings/items inside the rider vehicles or inside any roof boxes/luggage transporters.
We advise passengers to plan to arrive at the airport with plenty time prior to flight departure to allow for possible unpredicted delays enroute toor from the airport.
MEDFERRY SVC will not be responsibility for any passengers missing their flight under any circumstances.
Important warning for shared airport rider collections-
If you have agreed and are fully confirmed to travel in a shared rider transfer:
In the event of unexpected flight delays: Unless otherwise agreed, failure to meet your driver and fellow sharing passenger/s will likely result in a shared rider departing without you and your seat sharing price will still require to be paid.
Your driver may at his own discretion, may charge you for waiting time at the standard rates pro rata (currently $15.00 per hour) for any unexpected type of delay: Immigration, Passport control, lost luggage or baggage claims.
13 MEDFERRY SVC Privacy policy
13.1 MEDFERRY SVC uses the personal information given by visitors to this website when submitting forms only to improve our products and provide services.
We do not gather information in any other way.

14. Data Protection:

To process your booking, we will only share your personal information with your driver/rider operator selected to provide the service to you, but only as much necessary to perform these functions and improve our service.
Third party rider operators are forbidden to use this information for their own benefit.

Upon booking services we will not release any of your submitted data to other parties.
After booking and in the event the service needs to be carried out by a third party registered rider service provider we will only share following details in confidentiality:
Name – Phone number – Pick up time and date – Drop off address – Luggage description and the number of passengers.
16. I agree to follow and accept the following airport collection information/instructions:
16.1I agree to these Airport collection instructions - We will monitor your arriving flight. (We do not charge extra for waiting time for any flight delays on any private rider transfers).
17. Third party services:
MEDFERRY SVC uses Google Analytics to help understand use of our Services.
Google Analytics collects the information sent by your browser as part of a web page request, including cookies and your IP address.
17.1 Third-party sites:
Our site may contain links to and from other websites, advertisers and other third parties. If you follow a link to any of these websites, please note that they have their own privacy policies and that we do not accept any responsibility or liability for these policies.
